      803 KAR 2:040. Definitions.

      STATUTORY AUTHORITY: KRS Chapter 13A

      NECESSITY, FUNCTION, AND CONFORMITY: Pursuant to the authority granted the Kentucky Occupational Safety and Health Standards Board by KRS 338.051, the definitions listed below are adopted. Necessary for effective enforcement of the purposes and policies of the Occupational Safety and Health Act which is to insure so far as is possible, safe and healthful working conditions of Kentucky workers (KRS 338.011).

      Section 1. As used in these administrative regulations:

      (1) The definitions and interpretations contained in KRS 338.015 shall be applicable to such terms when used in these administrative regulations.

      (2) "Working days" means Monday through Friday but shall not include Saturday, Sundays, or federal or state holidays. In computing fifteen (15) working days, the day of receipt of any notice shall not be included.

      (3) "Compliance Safety and Health Officer" means a person authorized by the Commissioner of the Department of Workplace Standards, Labor Cabinet [Executive Director, Office of Occupational Safety and Health], to conduct inspections.
