      RELATES TO: KRS 346.080

NECESSITY, FUNCTION, AND CONFORMITY: KRS 346.080(6) and (7) provide that the board member to whom a claim is assigned shall make a decision either granting an award or denying the claim and allowing him to order a hearing if necessary to reach a decision. To secure a speedy and just decision, this administrative regulation sets the time limit for the board member to reach a decision or call a hearing.

Section 1. The board member to whom the chairman assigns a claim shall, in writing, approve, modify, or dismiss the claim or notify the board and claimant of the time and place of a hearing on the claim. The board member shall take one (1) of the foregoing actions within thirty (30) days of the assignment or within thirty (30) days after he receives a report of investigation, whichever occurs last.

Section 2. Hearings, if held, shall be public. The presiding board member shall require each hearing to be conducted with decorum. The proof required to support a claim shall be that required to support a claim in any court of competent jurisdiction. (3 Ky.R. 460; eff. 1-5-77.)
