AN ACT relating to the Crime Victims Compensation Board.
Amend KRS 346.020 to include pedestrians among victims of crime and to delete the requirement that certain crime victims must be needy in order to receive compensation; amend KRS 346.100 to permit the Crime Victims Compensation Board to deny a claim if the claimant fails to follow procedures; amend KRS 346.130 to permit the board to establish reimbursement for a crime victim's travel for medical treatment or mental health counseling; permit the board to set maximum rates for reimbursement of mental health services; increase the amount a victim can recover for lost wages; amend KRS 346.140 to delete provisions allowing for reduction of the amount of an award where the victim will not suffer financial hardship; require a criminal to pay restitution as a condition of probation, constitutional discharge, or parole; amend KRS 346.180 to conform.
HB 183 - AMENDMENTS
HCS/FN - Require the Crime Victims Compensation Board to reimburse a crime victim for travel for dental treatment; delete the reduction in crime victims compensation when community donations are received; permit a court or the parole board to set payment of restitution as a condition of probation, conditional discharge, or parole.
HFA (1, G. Lindsay) - Remove language allowing the fund to compensate victims of crimes occurring outside of the United States in countries which will not compensate the victim.
HFA (2, R. Wilkey) - Require that a person requesting compensation from the Crime Victims Compensation Board not receive compensation to the extent that the person has received payment from a life insurance policy in excess of $10,000 or from any other insurance policy.
