HB 393 (BR 1551) - J. Vincent, R. Wilkey, R. Palumbo
AN ACT relating to children's advocacy.
Amend the definition of "children's advocacy center" in KRS 620.020; amend KRS 620.050 to add civil and criminal immunity for employees or designated agents of children's advocacy center; prohibit disclosure of confidential information unless authorized; permit disclosure of confidential information in multidisciplinary team reviews; permit interagency confirmation of services and disclosure with a signed release; prohibit duplication of a recorded interview; amend KRS 610.127 to make technical correction.
HB 393 - AMENDMENTS
HCS - Retain original provisions, except clarify that medical examinations will remain as a service to be provided in a children's advocacy center; and make technical corrections.
HCA (1/Title, T. Burch) - Make title amendment.
HFA (1, J. Vincent) - Add language to subsection (5) that exempts new records created in subsection (6).
SCS - With regard to child abuse reports, delete criminal immunity for an employee or designated advocate of a children's advocacy center; place limits on information released to a guardian of a child in abuse cases; permit a parent or guardian to access records for his or her child if that parent or guardian is not currently under investigation; provide for the making of one report of the interview with a child in a child abuse case for use by the defendant's counsel and require counsel to return the report to the court clerk at the close of the case; provide for sealing all recorded interviews with a child at the conclusion of the case; provide that the amendment shall not contravene the Rules of Criminal Procedure.
