HB 576/LM (BR 1084) - R. Thomas, S. Nunn
AN ACT relating to animals.
Amend sections of KRS 258.005 to 258.087 to change and to create definitions, to require dogs, cats, and ferrets to be vaccinated against rabies, to allow a local health department to contract with veterinarians to administer rabies shots at clinics, to allow qualified persons to administer rabies shots to their own dogs, and to allow health officers to destroy and test animals suspected of having rabies; amend sections of KRS 258.095 to 258.500 to change and to create definitions, to require each county to administer and enforce dog licensing, to increase a dog license from $1.50 to $5.00 and to allow the county to keep $4.50 of the fee for a county animal disposal program or for some other animal control activity, to increase a kennel license from $10.00 to $25.00 and to allow the county to keep $22.50 of the fee for a county animal disposal program or for some other animal control activity, to change the term "guide dog" to "assistance dog", to use the terms "animal shelter" and "animal control officer" uniformly throughout the statutes, to delete references to the livestock fund, to require the Department of Agriculture to promulgate administrative regulations establishing standards for animal shelters and to make the Office of the Attorney General the enforcing agency, to lower the mandatory holding period for impounded dogs from 7 days to 5 days, to require animal shelters to keep certain records on all impounded dogs, to require owners claiming impounded dogs, cats, or ferrets to show proof of a rabies vaccination or to purchase a rabies voucher and for owners of dogs to show proof of a state license or to purchase a license, to require dogs, cats, or ferrets that have bitten someone to be quarantined for 10 days, to prohibit anyone from keeping a vicious dog, and to prohibit dogs from violating local nuisance ordinances; amend 257.100 to allow animal control officers to destroy abandoned and suffering animals; amend KRS 67.592, 189.575, 212.625, 321.181, 436.605, 436.610, and 525.010 to conform; make technical corrections; and repeal KRS 258.025, 258.115, 258.125, 258.275, 258.285, 258.295, 258.305, 258.325, 258.345, 258.355, and 258.991.
HB 576 - AMENDMENTS
HCA (1, R. Thomas) - Remove reference to "color" in reporting on persons bitten by an animal; remove language allowing the Department of Agriculture to issue state dog licenses directly or through other agents.
HFA (1, R. Thomas) - Permit governing bodies to contract with entities to perform animal control activities; clarify the violations in KRS 258.500 that are subject to penalties.
HFA (2, R. Thomas) - Require the Animal Control Advisory Board to make recommendations to the Commissioner regarding the policies and procedures for licensing and vaccinating dogs; require that administrative regulations relating to animal shelter standards become effective two years after the effective date of the Act; and require the Animal Control Advisory Board to review the rabies certification and dog licensing programs of the state and report to the LRC by December 1, 2002.
HFA (3, R. Thomas) - Delete the requirement that cats and ferrets shall wear rabies tags on collars and instead require the owners of cats and ferrets to provide proof of a valid rabies vaccination upon request.
HFA (4, P. Childers) - Retain original provisions of the bill; change the definition of "qualified person" to include a person who owns a cat or ferret; amend other provisions to include cat or ferret.
HFA (5, R. Thomas) - Delete provisions in KRS Chapter 258 that relate to Department of Agriculture administration of dog licensing; allow counties to establish dog and kennel licensing programs; delete provisions that relate to dog license fees and kennel fees; require failure of counties to comply with shelter standards to be prosecuted in local circuit court by the Commonwealth's attorney; transfer funds from the Livestock Fund into the Animal Control and Care Fund; repeal KRS 258.105, 258.145, 258.155, 258.165, 258.175, 258.185, 258.205; make technical corrections.
HFA (6, G. Stumbo) - Define "owner"; clarify who may seize unrestrained dogs; clarify that hunting dogs are still under reasonable control if engaged in hunting and get temporarily lost.
HFA (7, R. Thomas) - Delete provisions in KRS Chapter 258 that relate to department of agriculture administration of dog licensing; allow counties to establish dog and kennel licensing programs; delete provisions that relate to dog license fees and kennel fees; require failure of counties to comply with shelter standards to be prosecuted in local Circuit Court by the Commonwealth's attorney; transfer funds from the Livestock Fund into the Animal Control and Care Fund; repeal KRS 258.105, 258.145, 258.155, 258.165, 258.175, 258.185, 258.205; make technical corrections.
