HB 287/FN (BR 1280) - T. Riner

     AN ACT relating to the Uniform Emergency Volunteer Health Practitioners Act.
     Establish KRS Chapter 39G and create various new sections thereof; define terms; permit volunteer health practitioners to provide services in Kentucky during an emergency declaration; authorize the Department of Military Affairs to limit, restrict, and regulate the duration of practice by volunteer health practitioners, geographical locations, and types of volunteers; require host entities using volunteers in Kentucky to coordinate with the Department of Military Affairs; create a registration system for volunteers; establish criteria to quality as a volunteer health practitioner registration system; require the system to verify that the licensure of volunteers is in good standing; authorize various entities to confirm whether volunteer health practitioners are registered in the registration system; permit the volunteer registered to practice to practice as if the practitioner were licensed in this state; clarify that this Act does not affect credentialing or privileging standard of health facilities; require practitioners to adhere to their scope of practice; authorize the Adjutant General or his or her designee to modify or restrict the health or veterinary services that volunteer health providers may provide during an emergency; permit a host entity to restrict the health or veterinary services provided by a volunteer health practitioner; prohibit sanctioning for unauthorized practice unless the practitioner has reason to know of any limitation, modification, or restriction or that a similarly licensed practitioner in this state would not be permitted to provide the service; permit the Department of Military Affairs to incorporate into the emergency forces volunteer health practitioners who are not officers or employees of the state, a political subdivision of this state, or a municipality or other local government within this state; authorize the Department of Military Affairs to promulgate administrative regulations to implement this Act; amend KRS 311.560 to permit physicians licensed in other states to volunteer in Kentucky during an emergency declaration; amend KRS 313.030 to permit dentists licensed in other states to volunteer in Kentucky during an emergency declaration; amend KRS 314.101 to permit nurses licensed in other states to volunteer in Kentucky during an emergency; amend KRS 314A.105 to permit respiratory care practitioners licensed or certified in other states to volunteer in Kentucky during an emergency declaration; amend KRS 315.020 to permit pharmacists licensed in other states to volunteer in Kentucky during an emergency declaration; amend KRS 319.005 to permit psychologists licensed in other states to volunteer in Kentucky during an emergency declaration; amend KRS 327.020 to permit physical therapists licensed in other states to volunteer in Kentucky during an emergency declaration; amend KRS 335.010 to permit social workers licensed in other states to volunteer in Kentucky during an emergency declaration; amend KRS 321.200 to permit veterinarians licensed in other states to volunteer in Kentucky during an emergency declaration; amend KRS 321.441 to permit veterinary technologists registered in other states to volunteer in Kentucky during an emergency declaration; and cite this Act as the Uniform Emergency Volunteer Health Practitioners Act.

     HCS/FN - Retain provisions of the bill, except delete definitions of "Person" and "State"; delete details with regard to registering emergency volunteer health practitioners; delete details with regard to disciplining emergency volunteer health practitioners; require the Cabinet for Health and Family Services, rather than the Kentucky Department of Military Affairs, to promulgate administrative regulations to carry out the provisions of the Act; make technical changes; make conforming amendments; cite the Act as the Good Samaritan Act of 2007.
